NSW Law Reform survey on discrimination
Anti-Discrimination Act review - If you are a NSW resident please go to the link and fill out the survey before Friday 15th August.
The Law Reform survey addresses the Discrimination Act and includes questions about gender identity being a protected attribute.
Please make your answers clear and simple when responding to gender identity.
Gender identity is in direct opposition to biological sex which is also a protected characteristic. Gender identity denies reality and rejects science. Biological sex relies on reality and biological sex.
Use the examples of Sall Grover, Dr Jillian Spencer, myself and breastfeeding expert Jasmine Sussex. You can find plenty of blogs about these issues on www.binary.org.au along with fact sheets that can help form your answers.
Gender identity should not be elevated above sex-based rights. Gender identity is about feelings and perceptions that can not be standardised, measured or quantified. There is no medical or observable evidence to support a person's feelings that are not based in reality.
Biological sex is standardised, measurable and quantifiable. It is also a necessary attribute for certain spaces, services and sports. Prisons, rape crisis shelters, bathrooms, dormitories, sports etc should be sex segregated regardless of how a person identifies.
Please take ten minutes to complete the survey. The next steps according to the website will be more bureaucratic steps but it is important to have your say.
We’ll gather feedback through submissions, the survey, the Easy Read responses and consultations.
After this stage of consultation closes, we’ll release a second consultation paper. This will consider the procedures for enforcing the ADA, such as complaint processes and other options for addressing unlawful conduct. We'll also invite submissions on these issues.
