Giggle v Tickle hearing concludes

The appeal hearing in the Federal Court between Sall Grover, creator of the app Giggle for Girls, and trans-identified male Roxy Tickle, has concluded.

Both sides were appealing a previous decision by Justice Bromwich that found Sall guilty of indirect discrimination and penalised Sall for laughing at an image of a sweaty balls candle that mocked comments Tickle had made on the SBS Insight program.

Roxy Tickle claimed being called a ‘man’ was discrimination, despite the fact he is male. He wants more money than the original $10,000 that was awarded to him and a direct discrimination finding for being excluded from a female only app.

Sall Grover is fighting for women to have female only spaces and services. Her team argued that she discriminated according to his male sex, not his perceived gender identity that cannot be measured.

The hearing was mostly legal argument that was boring but necessary. It also contained some laughable and ludicrous moments.

Claims were made that Tickle’s selfie, used to try and access the app, portrayed him as female because he wore a v-neck t-shirt and had a woman’s haircut.

This is the image they were referring to:

Imagine being so ridiculous to claim that trying to emulate female stereotypes suddenly makes a person change sex! Does this mean that male sporting stars who wear v neck jerseys and have shoulder length hair are now female? What about these celebrity males?

The lawyers, barristers and judges all referred to Roxy Tickle as she/her/Ms despite him being male. How can a court of law be trusted to rule on this case fairly when they so blatantly subscribe to the lies? They are already captured by an ideology that rejects reality and imposes lies on society.

Despite the constant frustrations in court Sall Grover posted that she is relieved it is done and was very pleased with her legal team.

Finally, after 3.5 years, I feel like I can emerge from the Giggle v Tickle bubble I have been living in and it feels so good.

How am I feeling about it all?

So, so, so good. Better than I have ever felt before. Not just relieved but confident.

We took facts & the correct construction of the law into the court room. No emotion, no ideology. Just reality. This was the instruction I gave & it was achieved.

Activism is for outside a court room. Inside, it’s all about the law. My legal team consisted of some of the best legal minds in the country. Noel Hutley SC is one of the top 3 silks in Australia with over 40 years experience. He knew exactly what he was doing and his brilliant final oral submission will echo in my mind for the rest of my life.

Grover thanked her legal team and affirmed that everything she does is for their daughters and the females around the country. She reiterated that women’s sex based rights are worth fighting for.

The Sex Discrimination Commissioners interpretation of the law is bonkers. It is gender ideology in legalese. It is an attempt to enshrine a zeitgeist into legislation, while ignoring every group the sex discrimination act exists to protect in favor of one group: men who claim to be women.

If they need to create the Men Who Claim To Be Women Act, create it. But women need laws too and the sex discrimination act has to not only include but protect women otherwise there is absolutely no point to it.

The executive branch in Australia (aka the SDC) has gone rouge. The legislature is doing nothing about it. That leaves the judiciary. They are the checks & balance. And in that sense, there is every chance right now to establish that the system is working as intended.

In the first round, the trial was a circus and the judge was aggressively hostile. An appeal court is very different, and this court room felt very different. It is the second highest court in the land and very dry. Some might say boring. Judges are supposed to ask questions and doing so is absolutely no indication of their thoughts on the issue in front of them. It is them doing their job. They need to understand every aspect of an argument to decide on it.

Sall said she only needs two judges to find in her favour to win the case. She also confirmed she would go to the High Court if necessary.

Sall had many supporters attend the court hearing as well as thousands of online supporters who tuned in online. She also garnered international support from world famous author JK Rowling. When the hearing began JK Rowling posted: “Good luck, Sall. May the best woman (haha) win x”

After the conclusion of the hearing the famous author posted this:

Western society is currently divided between people who know this is a man and are prepared to say so and those who know this is a man but lie out of obedience to an ideology. There is no third option. Literally nobody on earth thinks "Roxanne Tickle" is actually a woman.

The decision will be handed down in 2-4 months.
